General Terms and Conditions (GTC)
1. Principles of activity
Thielmann Immobilien undertakes to fulfill brokerage assignments with the utmost care and objective consideration of the client's interests. Its work is carried out within the framework of generally accepted commercial principles and practices, in compliance with the professional code of conduct.
2. Order content
Thielmann Immobilien is commissioned to identify potential buyers or to broker a purchase agreement. The property is actively offered to prospective buyers and appropriately advertised. The contractor informs the owner about the feasibility of the purchase price expectations.
3. Sole contract
The client undertakes not to commission any third parties to market the property during the term of the contract.
4. Conclusion of the brokerage agreement
A brokerage agreement is concluded when you use an offer or exposé from Thielmann Immobilien, e.g., by contacting us or the owner/landlord directly. These Terms and Conditions come into effect upon receipt of the offer/exposé by mail, email, fax, telephone, internet, or personal delivery.
5. Commission on sale
For the proof or brokerage of the sale of a property, a commission of max. 3% plus statutory VAT is due, payable by the client.
6. Commission for rental
Bei der Vermittlung einer Vermietung beträgt die Provision max. 2 Kaltmieten zzgl. gesetzlicher Mehrwertsteuer.
7. Commission claim for alternative contracts
The customary local commission is also due if, instead of a purchase agreement, a rental/lease agreement (or vice versa) is concluded for the property offered or another property belonging to the same owner.
8. Due date of commission
The commission is due upon notarization of the purchase agreement or conclusion of the rental agreement. The client shall immediately notify Thielmann Immobilien of the conclusion of the contract and provide a copy/trace of the contract.
9. Dual activity
Thielmann Immobilien is entitled, due to legal regulations, to act on behalf of the buyer for a fee.
10. Reimbursement of expenses
If the owner terminates the contract prematurely without a contract being concluded, Thielmann Immobilien may invoice the actual expenses incurred.
11. Term and termination
The contract has a fixed term of 6 months and can be terminated with one month's notice.
12. Joint and several liability
Multiple clients are jointly and severally liable.
13. Indiscretion
Führt eine vom Auftraggeber zu vertretende Indiskretion dazu, dass ein Dritter mit einem von Thielmann Immobilien nachgewiesenen Anbieter einen Vertrag abschließt, schuldet der Auftraggeber eine Entschädigung in Höhe der entgangenen Provision.
14. Liability for information
Thielmann Immobilien relies on the information and details provided by the owner(s) and assumes no liability for their accuracy or completeness.
15. Confidentiality
All offers and communications are intended exclusively for the recipient, must be treated confidentially and may not be passed on to third parties without consent.
16. Disclaimer
Thielmann Immobilien assumes no liability for the properties and no liability for the creditworthiness of the contractual partners.
